By accessing or using BuildAR ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Payment and Refund Policy

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE.

We do not offer refunds, returns, or exchanges for any payments made on the Service, including but not limited to:

  • Scene publishing fees
  • View boost purchases
  • Validity extension purchases
  • Extra model purchases
  • Branding removal purchases
  • Any other paid features or services

By making a payment, you acknowledge and agree that you have reviewed your purchase carefully and that all payments are final.

3. User Responsibility and Content Ownership

YOU ARE SOLELY RESPONSIBLE FOR ALL CONTENT YOU CREATE, UPLOAD, OR PUBLISH THROUGH THE SERVICE.

You represent and warrant that:

  • You own or have the legal right to use all content (images, 3D models, videos, text) you upload
  • Your content does not infringe upon any third-party rights, including intellectual property, privacy, or publicity rights
  • Your content complies with all applicable laws and regulations
  • Your content does not contain illegal, harmful, or offensive material

BuildAR is not responsible for any content created by users. You will be held legally and financially responsible for any violations, claims, or damages arising from your content.

4. Pre-Publishing Confirmation

YOU MUST REVIEW AND CONFIRM ALL DETAILS BEFORE PUBLISHING YOUR SCENE.

Before publishing, you are required to:

  • Review all content, including 3D models, videos, text, and images
  • Verify pricing and payment amounts
  • Confirm scene configuration and settings
  • Ensure all content is appropriate and legally compliant
  • Check that you have proper rights to all uploaded materials

By clicking "Publish" or proceeding with payment, you confirm that you have reviewed everything and accept full responsibility for the published scene. No changes can be made after publication without creating a new scene.

5. Prohibited Uses

The following practices are strictly prohibited and will result in immediate termination of your account and potential legal action:

  • Creating content that violates any laws or regulations
  • Infringing on intellectual property rights
  • Publishing defamatory, libelous, or false information
  • Creating content that promotes violence, hate speech, or discrimination
  • Publishing adult, explicit, or inappropriate content
  • Using the Service for fraudulent or deceptive purposes
  • Attempting to reverse engineer or hack the Service
  • Sharing account credentials or allowing unauthorized access

Any violation of these prohibitions will result in immediate account termination, removal of all content, and we reserve the right to pursue legal action.

6. Zero Tolerance for Malpractice

BUILDAR HAS ZERO TOLERANCE FOR ANY FORM OF MALPRACTICE, ILLEGAL ACTIVITY, OR MISUSE OF THE SERVICE.

Malpractice includes but is not limited to:

  • Creating deceptive or misleading AR experiences
  • Using the Service to scam, defraud, or deceive users
  • Publishing content that could cause harm or injury
  • Violating privacy rights of individuals
  • Creating content that impersonates others or organizations
  • Any activity that could damage BuildAR's reputation or business

Creators found engaging in malpractice will be immediately banned, all their content will be removed, and we will cooperate fully with law enforcement and legal authorities. You will be held fully responsible for all consequences of your actions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDAR SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Content created, uploaded, or published by users
  • Third-party claims arising from user content
  • Service interruptions, errors, or technical issues
  • Any damages resulting from misuse of the Service

Our total liability for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS BUILDAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING LEGAL FEES) ARISING FROM:

  • Your use of the Service
  • Content you create, upload, or publish
  • Violation of these Terms
  • Violation of any third-party rights
  • Any illegal or unauthorized use of the Service

9. Service Availability

We strive to maintain service availability but do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.

  • Malpractice and illegal activities are strictly prohibited
  • You will indemnify BuildAR from any claims arising from your use of the Service
